These terms cover using Tend. We've kept them as clear and human as we can — please read them, especially the parts about medical advice and emergencies.
These Terms of Service ("Terms") are an agreement between you and Divine Health Technologies LLC ("Tend," "we," "us") covering your use of the Tend app, website, and text-message service. By using Tend, you agree to these Terms. If you don't agree, please don't use Tend.
1. Acceptance of these Terms
By creating an account or using Tend in any way, you agree to these Terms and to our Privacy Policy. If you're using Tend on behalf of someone else, you confirm you're allowed to. If you don't agree, please don't use Tend.
2. What Tend is
Tend is a personal health journaling and reminder app. It texts you a daily check-in, helps you log how you feel by text or voice, organizes your entries into a timeline, surfaces patterns for your own reflection, and can prepare a summary you may choose to share with your doctor. That's what Tend is for — keeping your own health story in one place.
3. Medical disclaimer
Tend is a personal health journaling and reminder tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment, and using Tend does not create a doctor-patient relationship. The information, reminders, summaries, and AI-generated content Tend provides are for your personal organization and reflection only and are not a substitute for professional medical advice. Always consult a qualified healthcare provider with any questions about your health or before making any medical decision. Never disregard or delay seeking professional medical advice because of something you read in or received from Tend.
4. Emergencies
Tend is not for medical emergencies. If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. If you are in crisis or having thoughts of self-harm, call or text 988 (Suicide & Crisis Lifeline) or text HOME to 741741 (Crisis Text Line).
5. Eligibility
You must be at least 18 years old to use Tend. Tend is intended for adults managing their own health information.
6. Accounts & responsibilities
When you create a Tend account, please give accurate information and keep it current. You're responsible for keeping your account secure — use a strong password and don't share your login. Tell us promptly if you think someone else has accessed your account. You're responsible for the activity that happens under your account.
7. SMS & messaging terms
By providing your mobile number and opting in, you consent to receive recurring SMS health check-ins and medication and appointment reminders from Tend. Message frequency varies (approximately one daily check-in plus any reminders you set up). Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. Consent to messaging is not a condition of using the core app.
8. Your content & data
The health information you log in Tend is yours, and you keep ownership of it. You grant us only the permission we need to operate Tend for you — to store, process, and display your entries, transcribe your voice notes, and generate the summaries and insights you ask for. How we collect, use, and protect your information is described in our Privacy Policy. You can export or permanently delete your data at any time.
9. Third-party services
To deliver Tend, we rely on a small set of trusted providers — for example, to send and receive text messages, transcribe voice notes, and generate summaries and insights. These providers process your information only to perform services for us. How your information is handled, including which providers are involved, is described in our Privacy Policy.
10. Acceptable use
Please use Tend only for its intended purpose — managing your own health information. Don't use Tend to break the law, infringe anyone's rights, upload another person's information without permission, attempt to access accounts or data that aren't yours, interfere with or disrupt the service, or misuse it in any way that could harm Tend or other people. We may suspend or close accounts that do.
11. Disclaimers of warranties
Tend is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee that Tend will be uninterrupted, error-free, or that messages and reminders will always be delivered on time. To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Tend is a tool to help you organize your health information — it is not a guarantee of any health outcome.
12. Limitation of liability
To the fullest extent permitted by law, Divine Health Technologies LLC and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of (or inability to use) Tend. Our total liability for any claim relating to Tend will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100). Some places don't allow these limits, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Divine Health Technologies LLC and its team from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of Tend, your violation of these Terms, or your violation of any law or the rights of another person.
14. Changes to these Terms
We may update these Terms as Tend evolves. If we make material changes, we'll let you know in the app or by email before they take effect, and we'll update the effective date above. By continuing to use Tend after changes take effect, you agree to the updated Terms.
15. Termination
You can stop using Tend and delete your account at any time from You → Delete account. We may suspend or end your access if you violate these Terms or to protect Tend or the people who use it. When your account ends, we handle your data as described in our Privacy Policy. The sections that by their nature should outlast your account — such as the medical disclaimer, disclaimers of warranties, limitation of liability, and indemnification — continue to apply after termination.
16. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or to Tend will be handled in the courts located in Ohio, and you agree to that jurisdiction — except where the law where you live gives you the right to resolve disputes elsewhere.
